The Nevada Supreme Court ruled the Green Party ineligible for the general election ballot on Friday, after lawsuit filed by Nevada Democrats.

The Nevada Green Party on Friday asked the US Supreme Court to weigh into an election dispute with potentially significant implications in the presidential battleground, asking the high court to pause a state court ruling that would keep candidate Jill Stein off the ballot.

The Nevada Supreme Court barred the Green Party from the state’s November general election ballot, overturning a lower court ruling in the party’s favor. In June the Nevada State Democratic Party filed a lawsuit alleging the Nevada Green Party submitted invalid signatures to appear on Nevada’s ballot.

In a 5-2 ruling released Friday, the high court’s majority said the minor party’s petition contained the wrong affidavit language, invalidating the signatures gathered to land on the ballot.

The Nevada Green Party on Friday asked the Supreme Court for an emergency intervention so its candidates can appear on the state’s general election ballot in November. Nevada’s top court in a 5-2 ruling last week excluded the party’s candidates because it used the wrong form when collecting signatures to gain ballot access.

In a 5-2 decision the Nevada Supreme Court ruled that even though the Green Party collected nearly three times as many signatures as required, the party would still not appear on the ballot over a technicality that was facilitated by the Democratic Secretary of State.

Some Republicans didn't want the competition and opt for petty procedural complaints to kneecap their Libertarian rivals.
